Copyright Infringement Policy (DMCA Compliance)
In accordance with the Digital Millennium Copyright Act (DMCA), we have established the following policy regarding copyright violations. We may, at our discretion, (1) block access to or remove content that appears to infringe on copyrighted material and has been unlawfully copied or distributed by advertisers, affiliates, content providers, members, or users of our services, and (2) suspend or terminate accounts of repeat offenders.
Your use of TwigsyHome services is always governed by our Terms of Service, which incorporate this Copyright Dispute Policy. Any undefined terms in this Policy carry the same meaning as in the Terms of Service.
Reporting Copyright Infringements
If you believe that material available through our Services infringes on your copyright (or the copyright of a person you are authorized to represent), you must submit a written notification of infringement containing the following details to our Designated Agent (contact information provided below):
-
A physical or electronic signature of the person authorized to act on behalf of the copyright owner.
-
Identification of the copyrighted work(s) claimed to have been infringed.
-
Identification of the allegedly infringing material, with sufficient detail to allow us to locate and verify it.
-
A good-faith statement that the use of the material is not authorized by the copyright owner, its agent, or the law.
-
Your contact information, including name, address, telephone number, and email (if available).
-
A declaration, under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the copyright holder.
Action Upon Receiving a Valid Notice
Once a valid copyright infringement notice is received by our Designated Agent, we may:
-
Remove or restrict access to the identified material.
-
Notify the content provider of the removal or restriction.
-
Terminate the content provider’s account if repeated violations are confirmed.
Counter-Notice Procedure
If you are a content provider and believe that your material was wrongly removed or disabled, you may submit a counter-notice to our Designated Agent. The counter-notice must include:
-
A physical or electronic signature of the content provider.
-
Identification of the material that has been removed or disabled, and the location where it appeared before removal.
-
A statement of good-faith belief that the material was removed or disabled due to mistake or misidentification.
-
Your name, address, telephone number, and email (if available).
-
A statement consenting to the jurisdiction of the appropriate court where you reside (or, if outside the United States, to any jurisdiction where TwigsyHome operates), and agreeing to accept service of process from the original complainant.
When a counter-notice is received, we may forward it to the party who filed the original claim. Unless the copyright owner initiates legal action within 10–14 business days, we may restore access to the material at our discretion.
